This web site (www.autolahome.com) is an interactive Internet online service operated and maintained by HQ Webusiness LLC. Autolahome.com offers Internet users (This is you, the user for www.autolahome.com) automobile and real estate related information and services provided by HQ Webusiness L.L.C., its affiliates and other information providers. 
This terms and condition also apply to those web sites powered by www.autolahome.com, such as the web site for autolahome.com registered dealer and realtor member.  
This terms and condition apply to non-registered user (public visitor without registration), individual registered member, registered dealer member and registered realtor member of www.autolahome.com.   
By using this web site, you accept the terms of this Terms of Service (hereafter TOS). This is a legally binding agreement between you and HQ Webusiness L.L.C. (autolahome.com). Please read it carefully. If you do not agree the terms and conditions of service or any change the service makes in these terms, please exit the service immediately.

Any suggestions or comments made by our member, if those suggestion or comments are used by HQ Webusiness LLC to make as a component or module as part of the autolahome.com dealer/realtor web site solution. Those suggestion and comments will become intellectual property of HQ Webusiness LLC. As an appreciation HQ Webusiness LLC will make those newly added features, which based on those suggestions and comments, available to those members who make those suggestion and comments at no charge. Depends on the workload of implementing the change or new feature, HQ Webusiness LLC might charge for developing the suggested feature for the first customer who request it or suggest it. But keep in mind after HQ Webusiness LLC finish the implementation of such feature, the feature becomes intellectual property of HQ Webusiness LLC. As a return to this customer who make the request or suggestion HQ Webusiness LLC will give this feature to this customer use for free.
Fee. You agree to pay the fees specified for the service package you select, regardless the outcome of your vehicle sales. Fees, in general, are not refundable. Failure to pay the fee will result in termination or suspension of service. 
Links to Other Sites. For your convenience, we provide a variety of links to other websites that we dont operate. You are responsible to use your own judgment for the information you obtain from those third-party websites. Autolahome.com  cannot hold liable for any damage for the usage of a third-party website. You need to be very careful when comes to purchase or apply for loan, insurance, service contract from those third-party company. Your own discretion need to be involved when comes to make a decision, a purchase, an application for service provided by those third party company or vendor. You are at your own risk for any decision you made. 
Dispute between buyer and seller. Our service is like that of newspaper's or magazine classified ads. Therefore, we do not get involved in any transactions, dispute, argument, lawsuit between buyers and sellers. 
Registration.  To obtain access to certain Autolahome.com services, you will need to register as a member. You agree that the information you supply during that registration process will be accurate and complete. Autolahome.com will protect your information based on our Privacy Policy. 
User Content. Autolahome.com will not verify the information seller supply or guarantee the vehicle they offer. It is you, autolahome.com users responsibility to use the same common sense and good judgment you would use in selling a vehicle through, or responding to a classified ad in the newspaper. 
When you list a vehicle or house in autolahome.com for sale, you must 1) prepare to sell that vehicle at the price, and the terms on which, you have listed it. 2) have possession of the actual vehicle. 3) list the information honestly. 
Private seller can not represent them as dealer or realtor. Private sells are only allowed to list one vehicle or one house at a time.    
Any raw material (include text, sound, image) provided by private seller, registered dealer member and registered realtor member will return to their owner as their request if they decide not to use Autolahome.com. As long as they are member of Autolahome.com, by placing material on or communicating with the www.autolahome.com web site and the Service, you hereby grant to Autolahome.com and its partners, including, but not limited to, registered dealer member, registered realtor member and their affiliates and related entities (collectively, the Partners) the royalty-free, perpetual, irrevocable, nonexclusive right and license to use, copy, modify, display, distribute and reproduce all such materials in any form, media, software or technology of any kind now existing or developed in the future. You also agree to indemnify, defend and hold Autolahome.com and the Partners harmless against any claims or costs, including attorneys fees, arising from the use or distribution of those materials. You further grant Autolahome.com and the Partners the right to use your name in connection with the reproduction or distribution of such material. 
Autolahome.com will backup user content in a daily basis. You agree that if your user content get lose in certain circumstances (include but not limited to, such as earthquake, server crash), you will not hold Autolahome.com in liable for such lose or post any legal charge against Autolahome.com. 
Dealer/Realtor Member Website Content.  Auotlahome.com provides web page editor and hosting our registered dealer/realtor web site. HQ Websuiness L.L.C. has no control on our dealer/realtor members web site in terms of, including but not limited to content, copy right, privacy policy, accuracy. HQ Webusiness L.L.C. can not be held liable for any lawsuit or dispute related to our registered dealer/relator members website. Even thought dealer/realtor web site are property of HQ Webusiness LLC, but each dealer/realtor will be responsible to the content they provider or compose since these inputs are contributed by our registered dealer/realtor member. HQ Webusiness LLC can only be hold responsible for contents HQ Webusiness LLC contributes.  
Dealer/Realtor Data Feeding to Third Party Website.  Auotlahome.com provides service to its member to allow them to export inventory from Autolahome.com to third party web site like Autotrader.com and Cars.com. It is dealer/realtors responsibility to check the data feeding results (such as inventory accuracy, content of ad and photo for Ad). HQ Webusiness LLC can not be hold responsible for any error associated with the data feeding.
Dealer/Realtor Data Importing to Autolahome.com.  Auotlahome.com provides service to its member to allow them to import data from their dealer management system (such as PBS and ADP) or realtor management system. It is dealer/realtors responsibility to check the data importing results (such as inventory accuracy, content of ad and photo for Ad). HQ Webusiness LLC can not be hold responsible for any error associated with the data importing.
Dealer/Realtor Custom Development.  Sometimes, dealers or realtors can request Autolahome.com to develop custom code for their special business requirement. Autolahome.com may charge a small fee for such effort. The fee dealer or realtor pay DOES NOT mean that dealer or realtor owns the ownership of the code (programming interface design and database code and programming code and IP). Autolahome.com will own all of the IP for the results/product of such custom development. The idea is that all of our customers help to build an online community. (e.g. dealer pay for Feature A, but dealer can get usage for Feature B, which is pay by another dealer. In this case, Feature B comes like free for this dealer.) New feature or function introduced will benefit all the users in this community. Considering that Autolahome.com only charge a marginal fee, but our dealer and realtor customer will have a feature that will help their business with a small cost, Autolahome.com will own all of the rights for such custom development and intellectual property (IP) as a results of this custom development. On top of that, other dealer or realtor that did not pay for this custom development can use the new feature or function as long as they are member of autolahome.com. Dealer and realtor pays for custom development will still paying the same monthly or annual fee after the custom development. This is another reason that autolahoem.com only charge a small fee for such custom development. Dealer or realtor that pays for custom development CAN NOT claim any ownership for such custom development and intellectual property (IP) as a results of this custom development. Autolahome.com owns every rights/results/intellectual properties for such development.
Prohibited Activities and Content. By using Autolahome.com, you agree not to post or transmit any defamatory, abusive, obscene, threading, misleading, or illegal materials, or any other material that infringes on the rights of others or interfered with ability of others to use Autolahome.com. The following is a partial list of the kinds of activities and content that are prohibited on or through the Service: (a)defame, abuse, harass, stalk, threaten or otherwise violate the legal rights of others (b) Publish, distribute any inappropriate, profane, defamatory, infringing, obscene, indecent or unlawful material or information. 
Email and Phone Number Usage. Its your responsibility to use sellers email and phone number only for vehicle buying/selling purpose. No spamming or data scrapping is allowed. As a seller, you are not allowed to supply autolahome.com with a false email address on purpose. 
Site Outages.  Autolahome.com cannot be held liable for any perceived or actual damages arising from the operation, content, or use of this site when 1) site is inaccessible 2) site may not function properly with your web browser and your operation system. 
Access to the Service. You agree that you will not: (a) use any robot, spider, other automatic device, or manual process to monitor or copy web pages or the Content contained in the Service or for any other unauthorized purpose without our prior expressed written permission; (b) use any device, software, or routine to interfere or attempt to interfere with the proper working of the Service and the Autolahome.com web site; and (c) take any action that imposes an unreasonable or disproportionately large load on Autolahome.coms hardware and software infrastructure. Frame autolahome.com in your web page is not allowed without permission.
Autolahome.com does not accept unsolicited materials or ideas for use or publication in its programming or in other digital, electronic or print media except in connection with the forums, chat rooms and bulletin boards on the Service. Autolahome.com and the Partners shall not be responsible for the similarity of any of its content or programming in any media to materials or ideas transmitted to the Service. 
Ownership of Website. The design, text, images, movie clip, sound, source code which driven the websites (websites include autolahome.com and web site HQ Webusiness LLC creates for their dealer or realtor member) function, and complied source code, software component, script code, Microsoft .NET assembly authored by HQ Webusiness LLC  are owned or licensed by HQ Webusiness LLC.
Autolahome.com member, dealer member and realtor do not own the web site autolahome.com or the web site HQ Webusiness LLC creates for their dealer or realtor member. Member of autolahome.com only has the right to use service provided by autolahome.com provided that member pays the fee for the service package they select. This is very similar to the case such as cell phone service subscriber. The cell phone service subscriber only pay to use the service, but the cell phone subscribe does not own the infrastructure to run cell phone business. Cell phone service carrier is the owner for the infrastructure to run cell phone business.     
Materials that belong to member, dealer member or realtor member ONLY include raw input from autolahome.com member, such as static text (e.g. text for about us page) for web content and raw image (e.g. dealer and realtor logo) for web page. When HQ Webusiness LLC creates the web page, dealer and realtor member agrees to give permission to HQ Webusiness LLC to use these raw materials in dealership or realtor web site. When dealer member and realtor member terminate their service agreement with HQ Webusiness LLC, dealer member and realtor member can ONLY ask return of those raw inputs that they supply to HQ Websiness LLC for creating their web page. 
Essentially, autolahome.com and those dealer and realtor web sites created by HQ Webusiness LLC for dealer and realtor member are properties of HQ Webusiness LLC.   Member, dealer member and realtor member can ONLY claim the ownership on those items that they supply to HQ Webusiness LLC for web page creation. HQ Webusiness LLC will release and return the raw materials provided by dealer or realtor member if dealer and realtor member decide not to use the service from Autolahome.com.  
Dealer and realtor member CAN NOT claim ownership on anything they DO NOT create, supply, compose and contribute. 
Autolahome.com Disclaimer: The information on vehicles provided in this Service is supplied by the seller or third parties, and Autolahome.com and the Partners cannot and do not verify or warrant the accuracy or completeness of the information. The Service and materials contained herein are provided on an as is, as available basis, and Autolahome.com and the Partners make no representations or warranties, expressed or implied, to any actual or prospective purchaser or owner of any vehicle as to the existence, ownership or condition of the vehicle, or as to the accuracy or completeness of any information about the vehicle contained in this Service. You acknowledge that any reliance upon any such materials shall be at your sole risk. Autolahome.com reserves the right, in its sole discretion, to correct any error or omission in any portion of the Service or materials. Any and all concerns, differences or discrepancies must be addressed with the seller prior to the sale of the vehicle. You agree to release, hold harmless and indemnify Autolahome.com and the Partners from any and all liability arising from incorrect or incomplete information regarding any vehicle. 
Autolahome.com and the Partners specifically disclaim any implied warranties, including the warranties of merchantability and fitness, for a particular purpose regarding any vehicle with information provided in this Service. All vehicles are subject to prior sales. 
General Disclaimer and Limitation of Liability. YOU EXPRESSLY AGREE THAT USE OF THE SERVICE IS AT YOUR OWN RISK.
